The rules of using Hooklayer.

Hooklayer is a viral-content intelligence API and Model Context Protocol (MCP) server operated by Protemco AI Lab. These terms cover how you can use Hooklayer, how billing works, what you can and can't do with the outputs, and the legal stuff. By creating an account or calling the API, you agree to these terms.

• You must be at least 16 years old.
• You must provide a valid email address and keep your account credentials secure. You are responsible for activity that happens under your account or your API keys.
• One person or company per account unless you're on a team plan that explicitly allows multiple seats.
• If you sign up on behalf of a company, you confirm you have the authority to bind that company to these terms.

Hooklayer exposes seven tools (analyze_account, score_hook, viral_remix, trend_pulse, find_viral_template, match_voice, predict_virality) over a REST API and an MCP server. Each tool takes inputs you provide (TikTok handles, hook text, scripts, video URLs), runs them through licensed third-party data providers and Anthropic's Claude API, and returns structured analysis or generated content.

All tools are read-only with respect to your social accounts. Hooklayer does not post to, modify, or delete content on TikTok, Instagram, YouTube, or any other platform on your behalf.

You agree NOT to use Hooklayer to:

• Generate content that is illegal, defamatory, harassing, hateful, sexually explicit involving minors, or that infringes intellectual-property rights.
• Impersonate a real person in a way intended to deceive the audience or damage that person's reputation. The match_voice tool is for ghostwriting and style-matching workflows, not for fraud or defamation.
• Scrape or aggregate Hooklayer responses to build a competing service, train a competing AI model, or resell the data outside of normal product use.
• Bypass rate limits, share API keys across organizations, or attempt to access tools or quotas you have not paid for.
• Probe, scan, or test the vulnerability of our infrastructure without prior written permission. Coordinated security research is welcome — email security@hooklayer.dev.
• Use the API in ways that materially violate the terms of service of the underlying platforms whose content we analyze (TikTok, Instagram, YouTube).

Violation of acceptable use can result in immediate account suspension without refund.

• Credits are the unit of usage. Each tool call consumes a documented number of credits. Credit costs are listed at hooklayer.dev/docs and may change with at least 14 days' notice.
• Free tier. New accounts receive 100 credits on signup, with a 30 requests/minute rate limit. The free tier is a one-time allocation, not a monthly grant.
• Paid plans. Subscriptions auto-renew monthly or annually depending on the plan you chose. Unused subscription credits do not roll over to the next billing period. Pay-as-you-go credits do not expire.
• Cache hits still consume credits. Hooklayer's determinism guarantee (same input → same output within 24h) is the product we sell, not free reruns. Charging on cache hits is intentional.
• Refunds. We refund unused subscription credits within 14 days of purchase if you have made no more than 50 tool calls. Pay-as-you-go credits and consumed subscription credits are non-refundable. Email support@hooklayer.dev within the window.
• Failed calls. If a tool call returns an HTTP 5xx error or an internal Hooklayer error, the credit is automatically refunded to your balance. Errors caused by malformed input on your side are not refunded.
• Payment processor. All payments are processed by Stripe. By subscribing, you also agree to Stripe's terms.

• Your inputs stay yours. Anything you send to Hooklayer (hook text, scripts, reference samples) remains your property. We use it only to fulfill the request and to bill the call.
• Outputs you generate are yours to use. Scripts, hook rewrites, scoring reports, voice-matched drafts — once returned, you can use them commercially, publish them, modify them, or pass them to clients without attribution to Hooklayer.
• The platform stays ours. The Hooklayer name, monogram, marketing copy, API design, tool schemas, scoring rubrics, and prompt engineering are property of Protemco AI Lab. You may use the name and logo to factually describe your integration (“built with Hooklayer”), but you may not imply endorsement or use our branding as your own.
• Analyzed creator content. When you call analyze_account or find_viral_template, the underlying public video content remains the property of its original creator and the host platform. Hooklayer returns derived analysis and transformative remixes; you are responsible for ensuring your downstream use complies with copyright and fair-use principles.

Hooklayer analyzes publicly available content from TikTok, Instagram Reels, and YouTube Shorts via licensed third-party data providers. We do not have any official partnership or endorsement from TikTok, Meta, Google, or YouTube. The platforms' own terms of service apply to any actions you take on those platforms based on Hooklayer's output.

Hooklayer is not responsible for changes to third-party platform APIs, policy changes by content hosts, or temporary unavailability of upstream data sources that may affect tool availability.

• We aim for high availability but do not guarantee uptime. There is no formal SLA on the free or self-serve paid tiers. Enterprise SLAs are available by contract.
• We may add, remove, or modify tools as the product evolves. Breaking changes to tool schemas will be announced at least 30 days in advance via email to active accounts and via the changelog at hooklayer.dev/whats-new.
• Scheduled maintenance and incidents are posted to the status page when they affect availability for more than 5 minutes.

• By you. You can delete your account at any time from the dashboard, or by emailing support@hooklayer.dev. Deletion removes your account, API keys, and associated data within 30 days. Subscriptions auto-cancel on deletion.
• By us. We may suspend or terminate your account for violation of these terms, payment failure beyond 14 days, or use that endangers the integrity of the service for other users. We will provide notice and a reasonable opportunity to cure unless the violation is severe (illegal content, fraud, security incident).
• What survives termination. The provisions on intellectual property, disclaimers, limitation of liability, indemnification, and governing law continue to apply after the account ends.

Hooklayer is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Virality scores, predicted reach, hook quality scores, and any other predictive output are statistical estimates based on historical patterns. They are not guarantees of future performance. Whether a piece of content actually goes viral depends on factors outside Hooklayer's visibility (algorithm changes, timing, audience composition, external news cycles). Use predictions as one signal among many, not as the sole basis for major business decisions.

To the maximum extent permitted by law, Protemco AI Lab and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, lost opportunity, loss of data, or business interruption — arising from your use of or inability to use Hooklayer.

Our total aggregate liability for any claim arising out of these terms or your use of Hooklayer is limited to the greater of (a) the amount you paid Hooklayer in the 12 months preceding the claim or (b) USD 100.

You agree to defend and indemnify Protemco AI Lab against any third-party claim arising from: your use of Hooklayer in violation of these terms, content you generate using Hooklayer that infringes a third party's rights, or your violation of any law or third-party platform's terms in connection with how you use Hooklayer output.

These terms are governed by the laws of the jurisdiction in which Protemco AI Lab is registered, without regard to conflict-of-law rules. Disputes will first be addressed by good-faith negotiation via support@hooklayer.dev. Any dispute that cannot be resolved within 60 days will be submitted to binding arbitration in the same jurisdiction, except either party may bring an individual claim in small-claims court.

You waive any right to participate in a class action against Protemco AI Lab to the extent permitted by law.

We will update the “last updated” date above when these terms change. Material changes (pricing structure, rights, dispute resolution) will be announced to active users by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
